Jurkowitz: Is 1st Amendment under attack?

With the trials of reporters Matthew Cooper of Time and Judith Miller of The New York Times set to begin tomorrow and the sentencing of Providence TV reporter Jim Taricani Thursday, Boston Globe media writer Mark Jurkowitz asks, Is the First Amendment under attack?

Not sure if you saw this, but the in the Hatfill v. NYT matter down in federal district court in Virginia, Judge Claude Hilton dismissed the case against the times writer Nick Kristof recognizing that the case raised important First Amendment concerns about the right of the press to discuss the work of a public agency. He also noted that the courts should "rebuff efforts to transform reports raising questions about matters of public concern into defamatory assertions of guilt."
